Illinois Senate Executive Committee Advances Bill the Would Allow Pharmacists to Dispense Emergency Contraceptives Without Prescription

Illinois lawmakers are moving forward with legislation that would make it significantly easier for residents to access a full range of contraceptive options, including the prescription-only emergency contraceptive Ella (ulipristal acetate), directly from pharmacists, without the need for a doctor’s visit.

House Bill 3489, championed by State Senator Rachel Ventura and State Representative Michelle Mussman, expands the types of contraception pharmacists can dispense to include not only hormonal birth control and the well-known Plan B (levonorgestrel), but also non-hormonal options like Phexxi and Ella, a prescription emergency contraceptive pill. Ella is considered the most effective emergency contraceptive pill, especially for people who weigh less than 195 pounds, and can be taken up to five days after unprotected sex, longer than other options.

Pharmacists dispensing these medications would be required to complete accredited training on contraceptive counseling, patient assessment, and the use of a self-screening risk assessment tool based on CDC guidelines. Patients would receive counseling about all available contraceptive methods, including those not covered by the standing order, in a private setting. The legislation allows pharmacists to dispense up to a 12-month supply of contraceptives, including emergency contraception, under a standing order from a physician or public health official, eliminating the need for a prior doctor-patient relationship.

If enacted, Illinois would join 30 other states and the District of Columbia in allowing pharmacists to prescribe contraceptives, with 17 of those states permitting extended supplies. This move is seen as a way to improve access to reproductive health care, particularly for those who face barriers such as lack of insurance, transportation, or available appointments.
